Copyright declaration

The legal basis of the policy of the journal "Earthquake Engineering. Constructions Safety ”, on which legal relations are built between the editorial staff, authors, reviewers and other participants in the publication process, is the legislation of the Russian Federation and international standards, including the principles set forth in the Declaration “Ethical Principles of Scientific Publications” (https://rasep.ru/ sovet-po-etike / deklaratsiya) (Moscow, May 20, 2016), adopted by the Association of Scientific Editors and Publishers (ANRI), in the provisions adopted by the World Conference on the Integrity of Scientific Research (Singapore, July 22-24, 2010) , and t Also reflected in the recommendations of the Scientific Publication Ethics Committee (https://publicationethics.org/). 
Copyright compliance is an important component of the journal’s activities. The editors use materials for publication solely subject to the rights of authors and third parties. The editors take adequate and sufficient measures to comply with copyright laws and to protect the copyrights of persons whose materials are published in the journal.
 
The editors of the journal are aware that the author of the work submitted for publication complies with copyright laws, respects the rights of third parties, and publication of an article in the journal will not result in a violation of rights, including copyrights. The author of the work, sending it to the publisher for publication, guarantees the originality of the work. The editors have the right to check the originality of the work for borrowings through the Anti-Plagiarism system, notifying the author of the work about the results of the verification.
 
The publication of articles in the journal is subject to copyright provided for, in particular, by part four of the Civil Code of the Russian Federation (Civil Code). Free reproduction and other use of works is allowed only in cases and on conditions stipulated by the legislation of the Russian Federation. In particular, the free use of a work is allowed for informational, scientific, educational or cultural purposes with the obligatory indication of the name of the author whose work is used and the source of borrowing (Article 1274 of the Civil Code of the Russian Federation), libraries, archives and educational organizations, provided there is no purpose for profit ( Article 1275 of the Civil Code of the Russian Federation).
 
The editors take into account that in the territory of the Russian Federation, in addition to exclusive rights to works established by the Civil Code of the Russian Federation, exclusive rights established by international treaties of the Russian Federation apply. Fundamental international treaties to which the Russian Federation is a party include the Berne Convention for the Protection of Literary and Artistic Works (Berne, September 9, 1886), the Universal Copyright Convention (Geneva, September 6, 1952), the WIPO Copyright Treaty (Geneva, December 20, 1996), Agreement on Trade-Related Aspects of Intellectual Property Rights (Marrakesh, April 15, 1994) and others.
 
The author of the work provides the publisher with the right to use his work on a non-exclusive basis. A licensing agreement on granting the right to use a work is concluded with the author before publishing his work in the journal.
